When can the placing parents sign the adoption consent or relinquishment?
An affidavit for voluntary relinquishment of parental rights or a consent to adoption must be signed at least 48 hours after the birth of the child.
Can placing parents who have consented to an adoption change their mind and revoke their consent?
Texas divides private adoptions into two categories: Agency and Independent adoptions.
In agency adoptions, the relinquishment is irrevocable by the birth parent upon signing.
In independent adoptions, the relinquishment is either revocable for 10 days or may be irrevocable for up to 60 days, becoming revocable on the 61st day unless a court with jurisdiction has entered an order terminating parental rights. The document must clearly establish whether it is revocable and how to revoke.
