Laws in Rhode Island

When can the placing parents sign the adoption consent or relinquishment?

A parent may execute the appropriate consents prior to the expiration of 15 days post birth. A petition to terminate parental rights and free the child for adoption may not be filed until the sixteenth day after the birth of the child and must be in writing and signed.

Can placing parents who have consented to an adoption change their mind and revoke their consent?

Yes, but revocation of consent is not automatic. Consent may be revoked only with court approval and upon showing that the revocation of consent is in the child’s best interests, within 180 days after the decree of adoption or termination of a parent's rights has been issued.
