When can the placing parents sign the adoption consent or relinquishment?

Placing parents are allowed to sign adoption consents at any time, including before the child’s birth. 

Can placing parents who have consented to an adoption change their mind and revoke their consent?

Yes. A placing parent can withdraw their consent within ten (10) calendar days of the signing, or within 10 days after the child is born, whichever is later. Placing parents may also sign a waiver of the ten-day period, in which case then they may withdraw their consent within five (5) days after it is signed or the child is born, whichever is later. To withdraw consent, the placing parent must file an affidavit with the probate division clerk of the circuit court in the county designated by the consent as the county in which the petition for adoption will be filed.
